Our office has handled numerous Construction Law and Litigation Matters and have worked for many Contractors. One of the most important tools a Contractor has to protect themselves is the filing of a Construction Lien. The substance, manner, and procedures involved in filing a Construction Lien have become so complicated we believe that only an experienced Construction attorney should be utilized to file the lien. A lien may only be filed within 90 days of completion of services or provision of materials. Unless work is being performed for the contracting owner directly then a lien may not be filed unless a notice to claim a lien has been filed within 20 days of commencement of work. There are other methods to collect payment for work performed such as through Contract Claims, Written Contract Claims, Oral Contract Claims, Unjust Enrichment under Montana Law, Quasi-Contract Liability and additional other possibilities.

WE PREPARE CONTRACTS TO AVOID LITIGATION: We prepare contract forms for contractors to utilize in their business on a regular basis along with change order forms which are tailored to the contractors business and regular types of customers to avoid disputes, provide for attorneys fees, ensure Montana Law applies and that costs and attorneys fees may be recovered if action is required to recover. Our contracts are prepared in a client friendly manner to increase the chances of getting the job by providing protection for both the contractor and landowner.
